Early in 2021, NRVJDH partnered with the 27th Court Service Unit and the local Virginia Juvenile Community Crime Control Act Programs (VJCCCA) to provide Home Electronic Monitoring (HEM) as an alternative to secure detention. Clients are placed on HEM through the court or through the local court service unit.


Rules

1. I understand that while on home electronic monitoring, I will be under the supervision of the New River Valley Juvenile Detention Home Electronic Monitoring Program and subject to all rules and regulations of the program.

2. I must keep my Home Electronic Monitoring Case Manager notified of my home address and phone number at all times. I will notify my Home Electronic Monitoring Case Manager immediately if there are changes to my present address and telephone number.

3. I understand that these rules are in addition to, NOT in place of, the rules of probation.

4. I understand that I must follow all instructions from HEM program staff and make myself available at any time of day or night. HEM program staff must always know my whereabouts.

5. I understand that HEM program staff may make unannounced visits to verify my whereabouts or to check the equipment.

6. I will NOT allow friends to be present in my home while on home electronic monitoring.

7. I agree to contact the detention center between 9:00pm and 9:30pm every day by telephone at (540) 381-0097 to check in. My parent/legal guardian must also be available to talk to staff if requested.

8. I will not engage in the use of any substance(s) which are illegal for my use as outlined by the laws of the Commonwealth of Virginia. I will share a list of my current prescription medication(s).

This list must be updated by my parent(s)/guardian(s) if this medication is changed at any time while I am participating in this program.

OUTSIDE ACTIVITIES:

9. I understand that I may not leave the interior portion of my home at any time without the permission of my Electronic Monitoring Case Manager/designee.

10. I understand that my Electronic Monitoring Case Manager/designee is the only person that may approve my schedule and/or change in schedule, and that I must request approval at least 24 hours prior to any change. This includes any type of employment, community service activities, and/or necessary appointments.

11. I will leave my residence to attend school at a set time and come directly home after school by my usual means of transportation. If school dismisses early, I will come directly home by the usual means of transportation ([ ] bus; [ ] parent/guardian pickup; or [ ] by an adult designated by my parent(s)/guardian(s) in advance.) I am to notify my Home Electronic Monitoring Case Manager/designee immediately if this information changes in any way.

12. I will only leave my residence to work at my place of employment based on the schedule given to my HEM Case Manager at the beginning of each week. I will share my current place of employment
and hours.

EQUIPMENT USAGE:

13. I understand that I am financially responsible for any damage to the electronic surveillance equipment.

All equipment must be returned to the detention center upon termination from electronic monitoring. This equipment is very expensive. I will be responsible for all costs related to lost, stolen, or damaged equipment. If I do not return the equipment in good working order, I may be charged with Grand Larceny and/or Destruction of Property.

14. I understand that if there are any problems with the equipment, such as a loosening of the strap, beeping, or strange noises, I will call the detention center immediately.

As the detention center uses the services of other agencies in order to help me, I give NRVJDH permission to discuss my needs and to release information to these other agencies, organizations, etc. that might be of assistance to me and to receive relevant information about my case from their files in return.

Affirmation by juvenile:

I have read, or had read to me, the above conditions of Home Electronic Monitoring and have received a copy of the supervision plan and program rules. I fully understand the supervision plan and rules of the Home Electronic Monitoring Program and agree to abide by them. I understand that if I violate these rules and regulations, I may be charged with Violation of a Court Order. By agreeing to these rules, I understand that my parent(s)/guardian(s) agree to actively participate in and support the enforcement of the rules, including reporting of violations immediately as outlined above.

Affirmation by parent/legal guardian:

As the detention center uses the services of other agencies in order to help my child, I give the New River Valley Juvenile Detention Home Electronic Monitoring Program permission to discuss my child’s needs and to release information to these other agencies, organizations, etc. that might be of assistance to my child and to receive relevant information about my child’s case from their files in return.

I have read, or had read to me, the above conditions of Home Electronic Monitoring and have received a copy of the supervision plan and program rules. As the parent(s)/guardian(s), I understand the supervision plan and rules of the Home Electronic Monitoring Program and agree to actively participate in and support the enforcement of these rules, including reporting of violations immediately as outlined above. I understand that if my child is missing from the home during evening and/or weekend hours, I am to report the juvenile as missing to the police department and notify the Case Manager/designee. The Court Services Unit will be notified during normal business hours. I also understand that New River Valley Juvenile Detention Home Electronic Monitoring Program only monitors the rules of the program and that as parent/guardian, I am ultimately responsible for my child and his/her conduct. NRVJDH will be responsible for monitoring this supervision plan and program rules, investigating violations of this order, and reporting the results of such investigations to the Court Service Unit and/or the Court.
